Hidden Disability Discrimination - The 'Driving Licence Trap': How Job Adverts and Automated Job Forms Quietly Break the Law

N.B. There is an easy read version at the bottom of this post (shorter and in bullet point form) as well as an infographic and translations

N.B. The legislation I refer to below is for the UK, but there should be equivalent legislation in other countries.

I would like to highlight that this practice does not only discriminate against disabled people.  It also discriminates against young people who have not yet passed their driving test, and against those from a poorer socioeconomic background who cannot afford driving lessons.  And as such, almost everyone will know someone that this affects and has a vested interest in challenging the practice from whichever point of view.

Have you ever found the perfect job, only to read the final bullet point: "Must hold a full UK driving licence"?

For millions of disabled people - including those with visual impairments, epilepsy, or physical disabilities - this single sentence instantly rules them out of this employment.  However, unless the job is literally for a delivery driver or a mobile carer, requiring a driving licence is often completely unnecessary.

In legal terms, this is a classic example of indirect discrimination under the Equality Act 2010.

When an employer applies a blanket rule that disadvantages disabled people, they are breaking the law unless they can objectively justify it.  Saying "you might need to travel to an occasional meeting" is not a valid justification.  Public transport, taxis, or Access to Work schemes are perfectly reasonable alternatives.

Employers shouldn't be allowed to simply copy-and-paste this requirement into job descriptions.  It isn't just bad hiring practice; it is systemic exclusion.

If you spot a discriminatory job advert, this is what you can do.  Use the template below to email the hiring team directly.

Subject: Inquiry regarding job requirements for [Job Title] - [Reference Number]

Dear Hiring Manager,

I am highly interested in applying for the [Job Title] role currently advertised on [Website Name].  However, I noted that the description lists holding a full UK driving licence as a mandatory requirement.

Could you please clarify if driving is an intrinsic, daily requirement for this role, or if alternative methods of travel can be accommodated?

Under the Equality Act 2010, blanket driving requirements for non-driving roles can constitute indirect discrimination, as they inadvertently exclude individuals who cannot drive due to a medical condition or disability.

I am confident my skills in [mention a key skill relevant to the job role] make me an excellent fit for this position, and I can easily manage occasional travel via alternative means (such as Access to Work).  I look forward to your clarification so that I may proceed with my application.

Kind regards,

[Your name]

This only deals with Job Adverts.  I will deal with Automated Job Forms in a future post.

Easy read

- There are many job adverts that put a blanket statement saying 'Must hold a UK driving license'

- This automatically rules out many disabled people (e.g. due to epilepsy or visual impairments).

- It may also rule out young people and people from lower socioeconomic backgrounds

- Regarding disability, this is indirect discrimination under the Equality Act 2010

- Companies cannot use blanket driving requirements for roles that do not specifically require driving (e.g. lorry driver)

- Occasional trips can be catered for in other ways (public transport, taxis, Access to Work)

- There is a template letter (above) that can be used to send to the hiring team to challenge the requirement

Vishay: [Job Title] pad ke liye naukri ki aavashyaktaon ke sambandh mein poochtaach — [Reference Number]

Priya Hiring Manager,

Mujhe [Website Name] par vartamaan mein vigyapit [Job Title] pad ke liye aavedan karne mein bahut ruchi hai. Halaanki, maine dekha hai ki job description mein full UK driving licence rakhna ek anivarya aavashyakta ke roop mein diya gaya hai.

Kya aap kripya spasht kar sakte hain ki kya is pad ke liye driving karna ek maulik aur pratidin ki aavashyakta hai, ya yatra ke anya tareekon ko bhi sveekar kiya ja sakta hai?

Equality Act 2010 ke tahat, un padon ke liye saamanya roop se driving licence ki aavashyakta rakhna jahan driving vaastav mein job ka hissa nahi hai, indirect discrimination ho sakta hai. Aisa isliye hai kyunki isse anjaane mein un logon ko bahar kiya ja sakta hai jo kisi medical condition ya disability ke kaaran drive nahi kar sakte.

Mujhe vishwas hai ki [mention a key skill relevant to the job role] mein meri skills mujhe is position ke liye ek excellent candidate banati hain. Agar kabhi-kabhaar yatra ki aavashyakta ho, to main alternative methods, jaise public transport, taxi ya Access to Work, ka aasaani se upyog kar sakti hoon.

Main aapke spashtikaran ki prateeksha karungi, taaki main apna application aage badha sakun.

Sadar,

Yeh keval Job Adverts se sambandhit hai. Automated Job Forms ke baare mein main ek future post mein baat karungi.

  • Bahut se job adverts mein ek saamanya statement hota hai: "Must hold a UK driving licence."

  • Yeh kai disabled logon ko automatically bahar kar deta hai, jaise epilepsy ya visual impairment ke kaaran drive na kar paane wale log.

  • Isse young people aur lower socioeconomic backgrounds se aane wale log bhi bahar ho sakte hain.

  • Disability ke sambandh mein, Equality Act 2010 ke tahat yeh indirect discrimination ho sakta hai.

  • Companies un roles ke liye blanket driving requirements nahi laga sakti hain jahan driving specifically required nahi hai, jaise lorry driver ki job.

  • Kabhi-kabhaar hone wali yatra ko anya tareekon se manage kiya ja sakta hai, jaise public transport, taxis ya Access to Work.

  • Upar ek template letter diya gaya hai jise hiring team ko bhejkar is requirement ko challenge kiya ja sakta hai.

Atentamente,

[Your name]
